Terms of Service

These Terms of Service (“Terms”) govern your use of Scaleify, a messaging service operated by Scaleify (“Scaleify”, “we”, “us”). By creating an account or using the service, you agree to these Terms.

1. The service

Scaleify lets businesses send WhatsApp review-request messages to their own customers through the WhatsApp Business Platform. We provide the software, message pacing, billing, and reporting; you provide the contacts and decide who is messaged.

2. Your account

You are responsible for activity under your account and for keeping your sign-in secure. You must provide accurate information and be authorized to act for the business you represent.

3. Acceptable use

• You must have a lawful basis and the recipient’s consent to message them, as required by WhatsApp’s policies and applicable law.
• You must honor opt-outs. Recipients who reply “STOP” must not be messaged again through the platform.
• You may only send messages that comply with the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy.
• No spam, harassment, misleading content, or messaging of purchased or scraped lists.

We may pause or suspend sending if we reasonably believe these rules are being violated or if message quality threatens deliverability for other users.

4. Billing

Scaleify is offered on monthly subscription tiers, each including a set number of messages and a per-message overage rate for usage beyond the included amount. Overage is drawn from a prepaid wallet balance. Subscriptions and payments are processed by Razorpay.

• Subscription fees are billed each cycle until cancelled.
• Wallet top-ups are prepaid and used to cover overage sends at your tier’s rate.
• Refunds are handled per our Refunds & Cancellation Policy.

5. Third-party services

Scaleify relies on Meta (WhatsApp), Razorpay, Supabase, Vercel, and Inngest. Your use of the service is also subject to the applicable terms of these providers. We are not responsible for outages or changes in third-party services outside our control.

6. Termination

You may stop using Scaleify and cancel your subscription at any time. We may suspend or terminate access for violation of these Terms or applicable policies. On termination, your right to use the service ends; certain provisions survive (e.g. billing for amounts owed, disclaimers, and limitations of liability).

7. Disclaimers

The service is provided “as is” without warranties of any kind. We do not guarantee message delivery, response rates, or specific business outcomes, which depend on WhatsApp, recipients, and factors outside our control.

8. Limitation of liability

To the maximum extent permitted by law, Scaleify will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the fees you paid us in the three months preceding the claim.

9. Governing law

These Terms are governed by the laws of India, and disputes are subject to the courts of competent jurisdiction in India.
